Terms and Conditions

These terms and conditions govern the use of services offered by Axiom Academic. By accessing the website and using our services, you accept these terms without reservation. We invite you to read them carefully.

Definitions

The terms below, when used with a capital letter in these terms and conditions, have the following meaning:

Axiom Academic
Refers to the group of companies operating under the Axiom Academic brand, whose main entities are AxEd INTL Pte. Ltd., parent company responsible for operations in Singapore, Southeast Asia and the rest of the world (excluding the United Arab Emirates), and AxEd Middle East LLC, responsible for operations in the United Arab Emirates and other Gulf countries. The associated website is www.axiom-academic.com.
User
Refers to any natural or legal person accessing the Axiom Academic website and using the services offered.
Tutor
Refers to any natural person delivering teaching in a particular field of competence, through Axiom Academic.
Client
Refers to any person who has concluded an agreement with a Tutor through Axiom Academic. The Client may be the Student themselves or a third party acting on behalf of the Student.
Student
Refers to the natural person receiving the Lessons.
Partner
Refers to any company partnered with Axiom Academic offering services to Students.
Course
Refers to the teaching delivered by a Tutor via Axiom Academic.
Lesson
Refers to an individual or group teaching session delivered by a Tutor to a Student, as part of the services offered by Axiom Academic.
Related Services
Refers to the additional services offered by Axiom Academic in addition to the Course.
Member
Refers to the Student, the Client or the Tutor having created a User Account and accepted these terms and conditions.
Platform
Refers to the Axiom Academic website accessible at www.axiom-academic.com, as well as the third-party tools used for managing Courses and payments, in particular the TutorCruncher platform, through which Users access the services offered.
Services
Refers to all the services offered by Axiom Academic, including the connection between Tutors and Students, as well as the tools for managing Courses, payments and communications.
Content
Refers to all elements provided by a Member or by Axiom Academic, such as texts, images, videos, sounds, data, graphics or any other element published on the Platform as part of the use of the Services.
User Account
Refers to the personal account necessary to become a Member and access the services offered by Axiom Academic.

Acceptance of Terms and Conditions

The use of the Axiom Academic website is subject to acceptance without reservation of these terms and conditions of use.

Axiom Academic reserves the right to modify these terms at any time. However, in the event of a modification occurring after the conclusion of a contract and before the execution of a Course, the terms initially accepted will remain applicable to that contract.

In the event of disagreement with any of the provisions of these terms and conditions, access to the website and use of the Services are not authorised.

Description of the Website

Axiom Academic is an online platform whose purpose is to create a contractual relationship between Tutors and Students, based on pedagogical, geographical and linguistic relevance criteria.

Axiom Academic enables the User to ensure regular monitoring of the lessons given as well as the communication of information necessary for their proper conduct.

Axiom Academic may provide certain support activities for Courses, such as the provision of rooms or teaching materials (non-exhaustive list).

Axiom Academic also acts as a payment intermediary for the contractual relationship created through it between the Tutor and the Client. Axiom Academic is not a party to the contract established between the Tutor and the Client.

Use of Services

The services offered on the Axiom Academic website may only be used in the context of the proper administration of Courses.

Members of Axiom Academic must create a profile to access the services. Users undertake to create only one profile on the website.

Users are subject to a general obligation of good faith. The interpretation of these terms and conditions must be made in light of this obligation.

Users undertake to provide only accurate information. Axiom Academic reserves the right to request supporting documents concerning the declared information.

The creation of a User Account is mandatory for all Members. This Account can be modified and administered from the dashboard provided.

Information Required to Create an Account

  • First and last name
  • Age
  • Location
  • Status (Tutor and / or Client)
  • Email address

Users undertake to ensure the truthfulness of the information provided.

Use as a Tutor

In addition to the information already mentioned, the Tutor must provide the following details:

  • Currency of remuneration
  • Subjects and levels taught
  • Availability
  • Geographical area of teaching
  • Description of experience and services offered
  • Information relating to the duration of stay in the city of teaching

Axiom Academic reserves the right to assess the relevance of Courses offered by the Tutor and may, at its discretion, accept or refuse a Tutor wishing to become a Member.

The Tutor undertakes to be perfectly transparent regarding the accuracy of the information provided about their training and references. Axiom Academic shall not be held responsible for any incorrect information provided by Tutors.

Use as a Client

In addition to the information already mentioned, the Client must provide the following details, whether the courses are intended for themselves or for a minor in their care:

  • Identity of the Student
  • School level of the Student
  • Subjects sought
  • Payment currency
  • Availability of the Student
  • Residence of the Student
  • Place where the Student wishes to take the courses
  • Estimate of the frequency and total number of courses desired

Axiom Academic Services

For Tutors

Axiom Academic analyses the data provided by the Tutor and compares it with course requests in order to draft an advertisement, determine the hourly rate and propose the most relevant Clients.

Axiom Academic undertakes to use all means at its disposal to submit the advertisement to the Students concerned. However, Axiom Academic has no obligation to systematically present a Tutor's profile: the advertisement will be presented only to Student profiles matching the Tutor's profile, based on the criteria and information entered in the User Account.

Axiom Academic undertakes to present to Students the profile of the Tutor who appears most suited to their needs.

Once the proposal has been accepted by the Client, Axiom Academic informs the Tutor by email. The Tutor is then free to accept or not. If certain points require clarification, Axiom Academic provides a suitable means of communication.

When the two parties (Tutor and Client) agree on the identity of the contracting parties, the subject, the level of the course, the price, the location and the date of the first lesson, a trial lesson is organised.

It is at the end of this trial lesson that the contractual relationship between the Tutor and the Client is deemed final. It is considered as such by default, unless notified otherwise to Axiom Academic via the means available on the platform. Refusal may be expressed by either party.

Axiom Academic is not required to communicate to the Tutor the credit of hours ordered by the Student.

Once the first lesson has been given, the Tutor has 3 days to validate, in their personal area, the lessons carried out during this period. The Tutor is paid by Axiom Academic the agreed amount, in the currency of their choice, once confirmation has been received. The Client then has 3 days to contest the validation. Beyond this period, the lesson is considered validated. The Tutor receives payment for lessons given during month N before the 6th of month N+1.

The Tutor is also paid for lessons scheduled but not carried out, when the cancellation is due to the Student and the Student has not informed the Tutor at least 6 hours before the start of the lesson. The Tutor must then inform Axiom Academic of this late cancellation.

The Tutor has, in their User Account, the means to confirm the completion of lessons or report incidents (Student absence, lateness, etc.).

The data collected via the lesson tracking tools may be used by Axiom Academic to improve the Tutor selection process.

As a payment intermediary, all financial transactions are handled by Axiom Academic. The Tutor undertakes not to receive payment by other means for any present or future contractual relationship established through Axiom Academic.

The Tutor undertakes to fulfil their tax obligations in force in their main country of residence concerning the sums received via Axiom Academic (income tax declaration and other equivalent tax obligations).

For Clients

Axiom Academic analyses the Student's needs and proposes the Tutor from its database who appears most suited.

Once a Tutor's profile has been selected, Axiom Academic handles the connection between the Tutor and the Client.

When the two parties agree on the identity of the contracting parties, the subject, the level of the course, the price, the location and the date of the first lesson, a trial lesson is organised. It is at the end of this trial lesson that the contractual relationship between the Tutor and the Client is deemed final.

The Client may terminate the contractual relationship at any time, provided they notify Axiom Academic within a period of 7 days. In the event of non-compliance with this period, the sums corresponding to the lessons that should have taken place between the last lesson carried out and the date of notification of termination to Axiom Academic will be lost.

After the creation of the first contractual relationship, the User Account may be reloaded with course hour credits by the Client, in renewal of the initial agreement. Any modification of this agreement must be reported to Axiom Academic as soon as possible.

The Client may order a number of course hours which will be credited to their User Account. Payment for the courses takes place at the time of order on the Axiom Academic website and with each new order of hour credits.

After each course, the Client receives a notification. It is the Client's responsibility to inform Axiom Academic, within 3 days, of any incident (absence, lateness, etc.) or modification of the initial programme.

The data collected may be used by Axiom Academic to optimise profile selection.

The Client undertakes to notify the Tutor and Axiom Academic in case of cancellation of a course at least 6 hours before the scheduled start, under penalty of losing the corresponding hour credit.

Rates and Service Fees

Axiom Academic adjusts the rate of courses according to the Student's needs, the skills, experience and certifications of the Tutor, as well as the geographical situation of the course (non-exhaustive list).

In return for its service, Axiom Academic receives a percentage of the sum paid by the Client, hereinafter referred to as "service fees".

When setting service fees, Axiom Academic takes into account several factors, such as the rarity of the course offered and the geographical situation of the course (non-exhaustive list).

Service fees may be adjusted according to discounts or promotional offers applied.

In the case of operations involving two different currencies, fees related to the exchange rate are borne by the Client, according to the rates in force at the time of the transaction.

Account Creation and Payment Methods

Client Account Creation

The registration journey at Axiom Academic takes place in several steps:

  • The User submits a course request via the contact form on the website www.axiom-academic.com.
  • A member of the Axiom Academic team gets in touch with the User as soon as possible to discuss their needs, their educational project and the modalities of support.
  • Once the modalities have been agreed between the User and Axiom Academic, the team manually creates a client account on the management platform TutorCruncher, accessible at secure.tutorcruncher.com/axiom-academic.
  • The User then receives their login credentials by email and accesses their personal area to follow the courses, view their invoices and manage their payments.

The creation of a client account is therefore subject to the prior validation of Axiom Academic. This step ensures that each programme is calibrated as closely as possible to the Student's needs from the outset.

Payment for Courses

Payment for courses is made from the User's personal area on the TutorCruncher platform, by bank card, in the currency of the country where the Lessons take place (or in another currency agreed with Axiom Academic).

The User may order course hours individually or in packs, in accordance with the modalities agreed with Axiom Academic. Each payment credits the client account, which is then debited by the amount corresponding to each Lesson validation by a Tutor.

Users must ensure that their account balance remains positive or zero. Email notifications are sent when the balance amount is insufficient to cover the next Lesson hour.

Bank Card Registration and Automatic Debit

The User may, if they wish, register their bank card in their personal TutorCruncher area. This registration is optional and remains entirely at the User's discretion.

When a bank card is registered on the client account, the User authorises Axiom Academic, in the event of a negative balance, to automatically debit the amount due in order to regularise the situation and allow the Lessons to continue. An email is sent to the User indicating the amount that will be debited, 3 days before the scheduled date of the debit. During these 3 days, the User has the possibility to manually credit their account or contest the amount.

The User may, at any time, remove their bank card from their TutorCruncher account, which terminates any authorisation for automatic debit for future operations.

A receipt is delivered for each payment, and the charges appear on the User's bank statement. If the indicated debit date falls on a weekend or public holiday, the payment may be executed on the next working day.

Payment Security

Secure payment processing is provided by Stripe, a PCI-DSS certified payment provider. Axiom Academic does not store any banking data on its servers: only the secure infrastructure of Stripe and that of TutorCruncher handle this information, in accordance with the strictest standards in the sector.

Liability

Axiom Academic acts solely as an intermediary in the relationship between the Tutor and the Client, and its liability cannot be engaged for disputes opposing these two parties.

Axiom Academic disclaims all liability in case of errors or inaccuracies in the information provided by the parties.

Axiom Academic disclaims all liability for the consequences related to non-compliance with confirmation deadlines.

Axiom Academic disclaims all liability concerning operations involving exchange rate risks.

Axiom Academic is bound by an obligation of means concerning access to the website. In case of impossibility of access to the website, or in case of technical problems of any nature, the Member cannot claim any damages or claim any compensation.

Axiom Academic reserves the right to make any modifications to the services offered by the website, without Members being able to claim any compensation.

Intellectual Property

Content published by Axiom Academic

Subject to the content provided by its Members, Axiom Academic is the sole holder of all intellectual property rights relating to the Service, the Platform, its content (in particular texts, images, drawings, logos, videos, sounds, data, graphics) as well as the software and databases ensuring their operation.

Axiom Academic grants the User a non-exclusive, personal and non-transferable licence to use the Platform and the Services.

Any other use or exploitation of the Platform, the Services and their content is prohibited without the prior written authorisation of Axiom Academic. The User undertakes in particular not to:

  • Reproduce, modify, adapt, distribute, publicly represent or broadcast the Platform, the Services and their content, except as expressly authorised by Axiom Academic.
  • Decompile or reverse engineer the Platform or the Services, subject to the exceptions provided for by law.
  • Extract or attempt to extract (in particular by using data scraping robots or any other similar tool) a substantial part of the data of the Platform.

Content published by the User

In order to enable the provision of Services and in accordance with the purpose of the Platform, the User grants Axiom Academic a non-exclusive licence to use the content and data provided as part of the use of the Services.

This licence allows Axiom Academic to broadcast this content via any digital network and communication protocol (in particular Internet and mobile networks), and to make available to the public the content of the Platform. Axiom Academic is authorised, worldwide and for the entire duration of the contractual relationship, to reproduce, represent, adapt and translate the Member content of the User as follows:

  • Axiom Academic is authorised to reproduce all or part of the content on any digital recording medium, known or unknown to date, including any server, hard drive, memory card or any other equivalent medium, in any format and by any process, to the extent necessary for storage, backup, transmission or download operations related to the operation of the Platform and the provision of Services.
  • Axiom Academic is authorised to adapt and translate the User's content, as well as to reproduce these adaptations on any current or future digital medium mentioned above, for the purpose of providing the Services, in particular in different languages. This right includes the possibility of modifying, while respecting the moral right of the User, the layout of the Member content in order to comply with the graphic charter of the Platform and to make it technically compatible for its publication via the Platform.

Code of Conduct

This charter applies to all Users in the context of the contractual relationship that unites them.

Tutor Commitments

  • The Tutor undertakes to offer courses adapted to the level and personality of the Student.
  • The Tutor undertakes to be punctual, rigorous and serious in the preparation and delivery of courses.
  • The Tutor presents themselves at courses in appropriate attire and maintains a cordial and professional attitude.
  • The Tutor undertakes to fulfil their tax obligations related to the income from their activity.

Student Commitments

  • The Student undertakes to be diligent, rigorous and punctual.
  • The Student undertakes to respect the Tutor and the teaching delivered.
  • The Student undertakes to provide a respectful learning environment conducive to the smooth running of courses.

Personal Data

The processing of personal data collected as part of the use of the Services is described in detail in our Privacy Policy. In accordance with applicable laws, you have rights regarding your personal data which you may exercise by contacting us at [email protected].

Applicable Law and Jurisdiction

These terms and conditions are governed by the laws applicable to the publishing entities, namely the laws of the United Arab Emirates for AxEd Middle East LLC and the laws of Singapore for AxEd INTL Pte. Ltd. Any dispute relating to the interpretation or execution of these terms shall fall within the jurisdiction of the competent courts of the relevant entity.
